Fiona Pearson

Biography

Fiona is a Senior Associate in the in the Commercial Litigation team.

Fiona is a commercial disputes lawyer with particular expertise in insurance related issues and professional negligence. She has experience of advising on insurance cover including professional indemnity, product liability, property, and D&O policy wording. In respect of her professional negligence practice, she has acted in a wide range of claims against professionals including solicitors, accountants, surveyors, financial advisors, LPA Receivers, insolvency practitioners and property managers. Fiona is experienced in High Court litigation, arbitration and mediation.

While at her previous firm, Fiona was seconded to a global insurance company as a financial lines claims adjuster.

Prior to her legal career, Fiona was a national press journalist.

Recent Experience
Providing coverage advice to a global insurer on aggregation issues arising between the client and the excess-layer insurer relating to a large scale multi-million pound mortgage fraud, successfully resolving the matter at arbitration.

Advising insurers on coverage issues and whether the dishonesty exclusion clause could be relied upon to decline cover to a firm of solicitors in relation to over 300 claims brought by a number of mortgage lenders in relation to bulk conveyancing transactions.

Acting for a firm of solicitors and its professional indemnity insurers in the joint defence of a lost opportunity personal injury claim against the solicitors and a barrister pleaded at in excess of £1m. Settling the claim through negotiation.
